Case study

A local authority and a commercial tenant disputed the amount payable for dilapidation under a commercial property contract. The dispute had already taken a great deal of time and effort. A number of experts had been involved on both sides with official offers having been made and refused. After some months the case appeared to be heading for court.

An individual working for the council suggested mediation. The company accepted the idea, and both parties agreed on the choice of mediator, an expert in property matters.

All pre-meeting communication took place over the phone, and both parties agreed to bring along written ideas of how to move forward. By doing this, and by agreeing to pare down the number of participants, the mediation process was concluded in a single meeting. A full settlement was reached and neither party has been in touch with us since.

The crucial benefit was the cost and time saved. It could take have taken up to two years to wait for this case to be heard and a settlement reached. The costs would undoubtedly be far higher with no certainty of a satisfactory outcome. In contrast, the mediation process typically costs £1500 – £2500 for a standard commercial dispute, and we would normally turn around a case like this in about six weeks.
